Monticello Wrongful Death Lawyers
Last updated on April 21, 2026
Nothing will ever be harder to face than the loss of a loved one. That loss can be compounded if it could have been prevented. When an accident could have been prevented through greater care, the person responsible needs to be held accountable for the loss of your loved one.
At Carroll, Turner and King P.S.C., we represent families across Monticello in wrongful death cases involving car accidents, medical malpractice, workplace incidents, nursing home neglect and defective products. When someone’s negligence or wrongful actions cost your family a loved one, we know how to hold them accountable in and out of the courtroom.
What Compensation Can Wrongful Death Claims Recover?
Financial recovery cannot bring your loved one back, but it can deliver real accountability and provide your family with a path forward. Wrongful death claims in Kentucky can pursue compensation across several key categories of loss, including:
- Funeral and burial expenses
- Medical expenses related to the fatal injury or illness
- Lost income and future earning capacity
- Loss of companionship, care, guidance and emotional support
- Punitive damages in cases involving gross negligence or intentional misconduct
At Carroll, Turner and King P.S.C., we will pursue every available category of compensation for your family.
Act Now To Preserve Your Right To Take Legal Action
We know that it can be difficult to consider bringing legal action for the loss of your loved one soon after that loss has occurred, but there are many reasons why it is best to engage our Monticello-based attorneys sooner rather than later. Statute of limitations issues can prevent you from holding someone accountable for the loss they have caused if you wait too long to begin the process.
Taking Care Of The Details For Our Clients
Because we know how overwhelming such a loss is, we focus our efforts on handling all the details for our clients. Our goal is to provide our clients with the ability to focus on their family and their own needs while we work to build a case that can create accountability.
Million-Dollar Verdicts And Settlements
At Carroll, Turner and King P.S.C., our firm has more than 50 years of combined experience that we bring to every case. We know that nothing is ever going to fill the space created by the loss of your loved one, but we can help you hold people accountable for your loss as well as pursue maximum compensation. Securing full compensation can provide financial stability for families who lost income when they lost their loved one.
We give every case our full attention, whether through settlement negotiation or courtroom litigation. That commitment has taken negligent drivers, corporations, health care providers and other responsible parties to account in courtrooms across Kentucky. From the first consultation to the final verdict, we are ready to fight for your family.
Who Can File A Wrongful Death Claim In Kentucky?
Under Kentucky law, the personal representative of the deceased’s estate holds the right to file a wrongful death claim on behalf of the surviving family. Spouses, children and parents do not carry the right to file that claim on their own.
State law also determines how any financial recovery reaches surviving family members. A surviving spouse has first priority, with children sharing in the recovery alongside the surviving spouse. Children receive the full recovery when no surviving spouse exists, and parents may recover when neither a spouse nor children survive. If no parents survive, the recovery goes to the deceased’s next of kin under Kentucky’s intestacy laws.
In most cases, the state sets a two-year statute of limitations on wrongful death claims, beginning at the date of death, although specific circumstances like delayed discovery in medical cases may affect this deadline. We help you make sense of your standing and move your case forward strategically before that deadline arrives.
